Negligence
Negligence is a tort which depends on the existence of a breaking of the duty of care owed by one person to another. There are four requirements before negligence is found. First, there must be a duty of care, such as a doctor to his patient. The second prong is that there was a breach of that duty. The doctor failed to perform with the normal medical standards, such as didn’t order a specific test or failed to give medications. The third prong is that breach was a proximate cause of an injury. This is known as causation. The last prong is there must be an injury. If there was no injury, then there is no legal cause of action.
